In the event of a future divorce, a couple may legally divide their assets and obligations through the use of an Arizona Prenuptial Agreement .
Prior to actually engaging into such an arrangement, each participant must reveal all of their financial records to the other party. Both participants of the agreement must affirm that they entered into the agreement willingly and without the other spouse's influence or compulsion. It is advised that the arrangement should be signed a minimum of least thirty days before the couple officially gets married and that each partner is given a minimum of five days to consider all of the details of the agreement before signing it.
The declaration must be signed voluntarily by both parties. Although it is not necessary by statute, it is also advised to get the document signed in front of a notary public as this will protect the integrity of the document, acting as proof that the agreement was signed voluntarily and that the conditions outlined in the document are valid legally.
